2016 Global General Counsels and Business Leaders (Beijing) Forum Held in Beijing—Perceive the Pulse of Legal World and Promote the Development of the Whole Industry

The premier event in China’s legal profession —2016 Global General Counsels and Business Leaders (Beijing) Forum was held grandly in Beijing on September 24. The Year 2016 is the first year of the “13th Five-Year Plan” of the government. Under the general trend of China’s economic transformation, the “new economy and new rules” have gradually become the strongest signal of the new normal of China’s economy. Held in this context, the forum had drawn wide attention from the legal profession. More than 60 experts, scholars and industrial authorities from government, enterprises, law firms and law schools including Yu Jianlong, the secretary general of China Chamber of International Commerce, Zhang Xuebing, the vice president of All China Lawyers Association, Zhao Bin, the global senior vice president of Qualcomm Incorporated, Shao Jiangning, the chief security officer of Microsoft (China) Co., Ltd, and Shi Jianzhong, the vice president of China University of Political Science and Law, had jointly discussed the most-concerned issues and hot events in the development of the legal profession. Nearly 300 legal and business elites attended the forum. The event was organized by China International Legal Affairs & Culture Exchange Center & Legal Guru Club, co-organized by Meijin Group, one of China’s top 500 private companies, as the primary sponsor, and greatly supported by Zhong Lun Law Firm, Qualcomm Incorporated and more than ten domestic and international top law firms. Highlight I: Plenary Meeting, Gathering of Top Global General Counsels and Business Elites

Guests attending the event included general counsels from the world Fortune 500 companies, executives from well-known companies in China and the world, partners in top law firms, as well as experts, scholars and government officials in the legal profession. Nearly 300 legal and business elites collectively appeared in the plenary session in the morning of September 24.

At the plenary session, Ms Angel Yingjun Wang, founder of the China International Legal and Cultural Exchange Center and Legal Guru Club, first gave an opening speech. Yu Jianlong, the secretary general of the China Chamber of International Commerce, and Zhang Xuebing, the vice president of All China Lawyers Association, delivered speeches respectively, perfectly opening the 2016 Global General Counsels and Business Leaders Forum (which is considered as 2016 Davos of Legal Profession).

The secretary general Yu Jianlong made an in-depth interpretation on the cognition and understanding of the “new economy and new rules”. He called upon the people in industrial, commercial and legal circles to get more involved in the formulation of international rules, to become the rule makers and to lead the way. He believed that the formulation of rules was divided into two levels. The first level was to actively utilize the industrial and commercial activities of B20 and G20 in terms of policies; and the second level was to actively use the nongovernmental business organizations, such as the International Chamber of Commerce and the China Chamber of International Commerce, in a specific trade or a certain field.

The president Zhang Xuebing conducted a macro-level and strategically-situated analysis of the challenges and opportunities created by the new economy and new rules to the legal service market. He elaborated on the changes in the four aspects of “traditional legal services, traditional criminal litigation business, traditional non-litigation business and traditional criminal defense business”. He believed that with the continuous extension of the legal service market, law firms needed to take efforts in expertise refining, precise training, forward-looking research and market differentiation to achieve uniqueness and perfection.

Subsequently, in the unique and novel “Ted Speech of General Counsels and Business Leaders”, Zhao Bin, the senior vice president of Qualcomm, Shao Jiangning, the Chief Security Officer of Microsoft China, and Gao Ping, the founding partner of Beijing Anjie Law Firm, gave wonderful speeches respectively, shared their respective industry experiences and received warm feedbacks from the guests.

Speech Topic: “Innovation and Intellectual Property Protection”

Combining years of practical experience, Mr. Zhao shared the four characteristics of innovation – high risk, high investment, long cycle and easy to copy, and proposed that: people shall not consider that intellectual property protection is the exclusive right of foreigners. It does not merely protect foreign people and foreign companies. In today’s new normal economy development, more and more Chinese companies, through years of accumulation, efforts and investment, have achieved many leading developments in science and technology and created many innovative achievements, all of which need to be protected by the intellectual property protection system. Therefore, maintaining and creating a strong intellectual property protection system is of greater significance to Chinese companies. ”

Speech Topic: “Best Privacy Protection Practices in the Age of “Cloud, Things, Big Data and Intelligence”

Mr. Shao shared the practices of Microsoft, the world’s leading technology and Internet company, regarding privacy and legal compliance. He proposed the seven principles of privacy design under the new economic situation — active and default privacy settings, privacy embedded design, positive-sum concept of privacy design, full lifecycle protection, visibility and transparency and respect for user privacy. Mr. Shao also believed that the ultimate goal was not privacy protection but gaining the trust of users. Microsoft has always emphasized the four principles, namely, security, privacy, compliance and transparency, in terms of gaining the trust of users.

Speech Topic: “Resolution to Commercial Disputes –Litigation or Arbitration?”

Ms. Gao Ping conducted a comparative analysis of the dispute resolution methods of litigation and arbitration from seven aspects: professionalism, impartiality, flexibility, efficiency, cost, confidentiality and implementation convenience. For complicated cases without foreign-related factors or with disputes of multiple parties involved, she tended to choose litigation. However, if a case involved foreign-related factors and might be necessary to apply for acceptance or enforcement from a foreign country, or if the case had a high degree of confidentiality, or some new cases requiring very professional personnel to hear, she preferred arbitration.

Finally, Nie Ying, the vice president of China Aviation Law Research Association, Yang Yuntao, the deputy general manager and general counsel of Sinotrans & CSC Holdings Co., Ltd, Qin Yuxiu, the deputy general counsel of China State Construction Engineering Cooperation and Cao Hui, the legal official of the Silk Road Fund made in-depth discussion of the assessment of investment value and the prevention of various legal risks under the “Belt and Road” policy.

Taking the China-Belarus Industrial Park — the largest industrial park along the “Belt and Road” in China as an example, Mr. Yang focused on the legal environment and risk prevention of investing in the Republic of Belarus.

Combining with China State Construction Engineering Corporation’s multiple projects along the “Belt and Road”, Ms. Qin deeply analyzed the political risks, capital risks, business payment risks and labor risks in the investment.

The theme shared by Ms. Cao is the opportunities and challenges of financial innovation in the construction of the “Belt and Road”. As an investor, the Silk Road Fund would take the project risk assessment, project partners, risks and guarantees after investment, diversified institutional arrangements for investment, and risk prevention and control mechanism, etc. into account.

Highlight II: Seven Major Sub-forums·Blossom in Radiant Splendor

In the afternoon of September 24, the seven major sub-forums, as the the key part of the forum, were started. The topics of the sub-forums covered seven major fields, namely management and arbitration process, corporate governance, anti-monopoly law, data privacy, cross-border mergers and acquisitions, corporate compliance and intellectual property rights.

The topics were determined in an unprecedented method — voted by more than 70 general counsels or legal heads from the world’s top 500 companies. It meant that in the sub-forums, attendees could not only hear the wonderful interpretation of the key issues of the profession by the top general counsels and perceive the pulse of the world law; but also more pro-actively foresee the development trend of the legal profession and create the future of the legal profession hand by hand!

There are more than 30 high profile speakers in the seven major sub-forums, including corporate general counsels or legal business leaders, law firm partners, industry scholars and government officials. Speakers gave unique analysis and in-depth discussions on the same topic from different perspectives.
